Ministerial Intervention


Ministerial Intervention is a request to the Minister of Immigration to use his "Public Interest"  powers, to intervene and substitute a more favourable decision than that of the Tribunal.

The Minister can only  intervene where a Tribunal has issued a decision. I.e. Refugee Review Tribunal, Migration Review Tribunal and in some cases the Administrative Appeals Tribunal.

The Kah Lawyers Community Access team are experienced in preparing Ministerial Requests.

The Minister generally only reviews cases that are "unique" or have "exceptional" circumstances. The Ministerial submission must be prepared to show in the first instance the compelling reasons for the request.
