Wills
Every person should have a current will. Your will is a legal document and is the only way to ensure your assets are divided according to your wishes. In your will, you nominate who you would like to look after your affairs and ensure your wishes are carried out.
If you do not have a valid will and die, your family and friends are left with making arrangements that may not be what you wanted. Dying without leaving a will often causes heartache, anguish and arguments amongst your children, family and friends.
Probate
Probate needs to be granted by the Supreme Court before the Executor or Executrix of a will can implement the wishes of the deceased. Most banks will not release funds to another person without Probate being granted.
To be granted probate there are legal requirements to be fulfilled in accordance with the Supreme Court rules.
